As of:<\/strong> January 2025<\/p>\n\n\n\n 1.1.<\/strong> These Terms and Conditions (T&C) apply to the use of the SustainProp platform, operated by the respective service provider (hereinafter referred to as \u201cprovider\u201d or \u201cwe\u201d).<\/p>\n\n\n\n 1.2. <\/strong>SustainProp provides a platform for real-time analysis of real estate and for identifying potentials based on data provided by the user.<\/p>\n\n\n\n 1.3. <\/strong>User\u2019s conflicting terms and conditions shall not apply unless we have expressly agreed to their validity in writing.<\/p>\n\n\n\n 2.1. <\/strong>The subject matter of these GTC is the use of the SustainProp platform by the user for the analysis of real estate and the provision of related services.<\/p>\n\n\n\n 2.2. <\/strong>The details regarding the offered services, the respective prices, subscription models, and commissions are set out in a separate price and service overview. This overview forms part of the contractual relationship and is provided to the user prior to the conclusion of the contract.<\/p>\n\n\n\n 3.1.<\/strong> Use of the platform requires registration. The user is obliged to provide truthful information during registration and to update it immediately in the event of any changes.<\/p>\n\n\n\n 3.2.<\/strong> Upon registration, the user receives access to a personal customer account, in which they can manage, modify, and delete their data.<\/p>\n\n\n\n 3.3. <\/strong>Access to the platform is provided via the Internet. The user is responsible for providing and maintaining an appropriate internet connection.<\/p>\n\n\n\n 3.4. <\/strong>The user may only use the platform within the scope of the contractually agreed purposes. Any abusive use, in particular the use of the platform for the collection or processing of data without the corresponding authorization, is prohibited.<\/p>\n\n\n\n 4.1.<\/strong> We offer various services and service packages that can be purchased as one-time services or as part of subscriptions or framework agreements. The exact terms, durations, and prices of the individual models, as well as any discounts and special offers, are specified in the price and service overview.<\/p>\n\n\n\n 4.2. <\/strong>The user can choose between different subscription or framework agreement models that differ in scope and price. The subscription commences on the day the contract is confirmed by us.<\/p>\n\n\n\n 4.3. <\/strong>Within the framework of subscriptions, additional chargeable services may be utilized. These will be invoiced separately unless they are part of the chosen model.<\/p>\n\n\n\n 4.4. <\/strong>The prices for the use of our services are reviewed regularly and may be adjusted after the agreed minimum contract term has expired. Price changes will be communicated to the user by email at least four weeks before they take effect. If the user does not object to the price change within two weeks after receiving the notification, the change is deemed accepted.<\/p>\n\n\n\n 4.5.<\/strong> Some services on the platform may be provided by third parties or partner companies. In such cases, we will inform the user in advance. These third parties may enter into a bilateral agreement with the customer, which includes separate invoicing. For services provided by third parties, only the respective General Terms and Conditions or agreements between the customer and the third party shall apply. We assume no liability for services provided by third parties.<\/p>\n\n\n\n 4.6.<\/strong> In some cases, we may receive a commission or fee for mediating services provided by third parties.<\/p>\n\n\n\n 5.1.<\/strong> Payment is made in accordance with the terms specified in the price and service overview. In general, our services are compensated by one-time fees.<\/p>\n\n\n\n 5.2.<\/strong> All prices stated, unless otherwise specified, include the applicable statutory VAT.<\/p>\n\n\n\n 5.3.<\/strong> In the event of payment default by the user, we are entitled to suspend access to the platform until all outstanding amounts are settled. Further claims remain unaffected.<\/p>\n\n\n\n 5.4.<\/strong> In the event of disputes regarding the performance provided by SustainProp, a mediation body shall first be consulted. Withholding of invoice amounts is excluded unless the outstanding amount is transferred in accordance with a payment plan to a trustee account of a mediation body or a court account. In the case of one-time payments without installments or advance payments, the entire amount must be transferred to the trustee or court account corresponding to the measure. Withholding without such payment is excluded.<\/p>\n\n\n\n 6.1. <\/strong>The duration of the contract is determined by the subscription model chosen by the user and begins with the confirmation of the contract by us.<\/p>\n\n\n\n 6.2.<\/strong> The contract may be terminated by either party with one month\u2019s notice at the end of the respective contract term. If no termination is received, the subscription will automatically be extended by the agreed contract term.<\/p>\n\n\n\n 6.3. <\/strong>The right to immediate termination for cause remains unaffected. Immediate termination is particularly justified if the user breaches essential provisions of these GTC.<\/p>\n\n\n\n 7.1.<\/strong> We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.<\/p>\n\n\n\n 7.2.<\/strong> In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable, typical contractual damage.<\/p>\n\n\n\n 7.3.<\/strong> Any further liability is excluded.<\/p>\n\n\n\n 7.4.<\/strong> The platform is provided “as is” and we do not guarantee its availability at all times or its suitability for specific purposes. Technical or other errors cannot be completely excluded.<\/p>\n\n\n\n 7.5. <\/strong>We assume no liability for services provided by third parties or partner companies. For such services, only the agreements made between the customer and the third party shall apply.<\/p>\n\n\n\n 8.1. <\/strong>The protection of our users’ personal data is of the highest priority to us. The processing of personal data is carried out solely in accordance with the applicable data protection laws and in accordance with our Privacy Policy.<\/p>\n\n\n\n 8.2. <\/strong>The user agrees to the processing of their data in accordance with the Privacy Policy. The Privacy Policy forms part of these GTC.<\/p>\n\n\n\n 9.1.<\/strong> We reserve the right to change these GTC at any time with effect for the future.<\/p>\n\n\n\n 9.2.<\/strong> Amendments to these GTC will be communicated to the user by email at least four weeks before they take effect. If the user does not object to the changes within two weeks after receiving the notification, the changes shall be deemed accepted.<\/p>\n\n\n\n 10.1. <\/strong>The law of the Principality of Liechtenstein and the law of the European Economic Area (EEA) shall apply. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.<\/p>\n\n\n\n 10.2.<\/strong> The place of jurisdiction for all disputes arising from or in connection with these GTC shall be the registered office of SustainProp, provided that the user is a merchant, a legal entity under public law, or a public-law special fund.<\/p>\n\n\n\n 10.3. <\/strong>If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall apply that comes closest to the economic purpose of the invalid provision.<\/p>\n\n\n\n 10.4.<\/strong> Any collateral agreements, amendments, and supplements to these GTC must be in writing.
